HTC Did Not Breach Patent Rights

Yesterday International Trade Commission (ITC) made a decision in favor of one of world’s leading smartphone makers, HTC, which was sued by FlashPoint Technology Company (formerly Apple daughter company) for allegedly illegal use of digital photography patent.

After an investigation, ITC now says there was no violation of such rights so HTC can concentrate on its other legal battles, such as for example with IPCom — German patent maker. It is becoming a trend for competing companies to use patent issues for getting their shares from ever growing smartphone popularity, and HTC is not alone in its struggle in this.

US based FlashPoint had complaints in the past related to patent rights breach with companies like Nokia, Research in Motion and LG Electronics, but the companies had settled all issues without going to court. The ITC in its turn has already become a convenient platform for patent infringement cases, since it has an authority of complete ban to any product, which infringes patent rights.
